These Terms of Service ("Terms") govern your use of Billow (the "Service"), operated by Trueform GmbH ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to misuse the Service, including by violating laws, infringing others' rights, transmitting harmful code, or attempting to gain unauthorized access to our systems.

4. User Content

You retain ownership of content you submit. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and display it as necessary to operate and provide the Service.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and process personal data and is incorporated into these Terms by reference.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Trueform GmbH and protected by applicable intellectual property laws.

6. Payment and Subscriptions

Subscriptions. Access to paid features of the Service is offered on a subscription basis. Fees, billing cycles, and any applicable taxes are described at the point of purchase. Subscriptions renew automatically for the same period unless you cancel before the renewal date. Except where required by law, fees are non-refundable.

Payments you collect (Stripe Connect). The Service lets you connect a Stripe account to collect payment on invoices you issue to your own clients. When you do, you are the merchant of record for those transactions, your use of Stripe is governed by Stripe's own terms, and you are responsible for your relationship with your clients and for any taxes arising from those transactions. We facilitate the connection but are not a party to payments between you and your clients.

7. Termination

We may suspend or terminate your access at any time for violation of these Terms. You may stop using the Service and close your account at any time.

When your account is closed, your data remains available for export and recovery for 30 days, after which it is permanently deleted from our active systems, except for records we are legally required to retain. You can request an export of your data during this period.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Trueform GmbH shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles. The courts of the Canton of St. Gallen, Switzerland shall have jurisdiction, subject to any mandatory consumer protection rights you may have in your country of residence.
